We are excited to host you! Please be sure to read carefully.
MAXIMUM OCCUPANTS: only the specific number of guests (children included) in the booking are allowed on premises unless approved in writing by host. If the guest exceeds the occupancy noted in the reservation, all guests and/or visitors to the property can be immediately evicted without refund for unused days remaining. Guest also agrees to pay a charge of $50 per person/per day for every visitor not identified by guest (children included) in the reservation AGE & ID's: Registered guests must be 25 years or older at the time of booking in order to reserve the property. Guest confirms that he/she is older than 25.
CHECK-IN: is 4 pm or after. Your door code will not work until your check-in time.
CHECK-OUT: 10 am Check-out is defined as all guests and personal property being completely off the property. Guest agrees to pay a $75 fine if not checked out by the specified check-out time. A late check-out may be allowed if the host gives written approval prior to check-out time.
PETS: There are to be no pets on the property - except with prior written authorization of the hosts. Guests are to pay a $250 nonrefundable fee to bring their pet. Guests who bring pets without approval will be charged a $500 pet fee and will be immediately evicted from the property without refund for remaining days on the reservation.
SEPTIC SYSTEM: Our home is on a septic system, therefore there is no garbage disposal in the kitchen and food and debris absolutely cannot go down the drain. Mesh stoppers are in place. Dispose of food and debris as needed in trash cans. We thank you very much.
KITCHEN: Stove, sink microwave, dishwasher and refrigerator shall be clean and free of grease and food. Dirty dishes shall be washed and put away.
KITCHEN ITEMS: All items in kitchen including silverware, pots/pans, flatware etc. have been counted and any item removed from premises will be charged to the guest.
BATHROOM: Toilet cannot have anything other than toilet paper. Disposing of feminine items, wipes etc. will set off our septic alarm and clog pipes. Please dispose of all other items in the waste bin. Hair catch for shower must be kept in place to prevent hair from clogging pipes.
CHANGE OF LOCKS: Guest shall not re-key or change out the door locks/door hardware under any circumstances.
SECURITY CAMERAS: There are outdoor cameras on the property, covering the driveway and front door. Do not touch cameras. This includes but is not limited to covering with an object, repositioning etc. Doing so would incur a fee if cameras must be fixed or repositioned and/or removal from property with no refund on remaining days.
REPORTING DAMAGE: Guest agrees to keep the property in same condition throughout their stay. Any damage to furnishings, fixtures, or furniture or other notable conditions found upon arrival must be reported to the host within one (1) hour of occupancy. Guest must also notify us immediately of any maintenance issues that occur during their stay so as not to cause a larger issue (water leak, clogs etc.).
YARD SHED: Shed in the backyard is not for public/guest use and is locked. Do not enter.
BUGS AND LIZARDS: This is a subtropical area. Please expect to see lizards, and other critters possibly outside, and occasionally indoors. We have taken steps to make sure this is a rarity, but open doors can lead them in quickly to cool air.
ANTS: The area has teeny tiny ants that LOVE left-out food and can infest within a day! Eating is only permitted at the bar and dining table for this reason. Please store in refrigerator or if room temp in airtight containers (we do provide some basic Tupperware). Please pick up/wipe up food that drips, drops etc. If infestation occurs, you will be liable for the cost of pest control.
FIRE: No candles or open flames of any kind inside or outside the house.
OTHER: No dying hair permitted. No glitter, confetti, paints etc.
MOVING FURNITURE: Do not re-arrange furniture or items in house in or outdoors.
LINENS: White towels and beach towels are not to be used for makeup or spills. Use paper towels and/or marked bin of separate towels in the linen closet to be used for such. Guests are not to wash laundry that belongs in the home ( ex: do not wash our towels and sheets, our cleaning crew has specific guidelines for stains, health and safety of guests). Unsalvageable linens/bath towels will be charged to the guest.
CHILDREN: While children are welcome, please know we do not have any childproofing, highchairs, playpens etc. You are personally and legally responsible for and must always supervise them. Do not leave children unattended in guest rooms or allow them to roam inside/outside of the property unsupervised.
ADDITIONAL CLEANING FEES: At sole discretion of host, an additional cleaning fee based off extra charge of cleaners can be charged if additional cleanup is required that goes above and beyond the standard cleaning.
GUEST-RENTER RESPONSIBILITES & TERMS: You, as lessee, are responsible for payment, deposits and all facets and terms of the Lease as detailed in this rental agreement, including good neighbor guidelines. This agreement is a binding legal contract, and it is agreed that it must be construed as if both parties jointly wrote it, governed by Florida law. Your confirmation on Airbnb and payment of money or taking possession of the property after receipt of the Agreement, is evidence of your acceptance of the Agreement and your intent to use this property for a vacation rental. The Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof. The rented Property is a privately owned home. You agree to indemnify the Lessor/owner of said property for all liability, damage, personal injury, or loss to the Property or its contents that occur during your stay resulting from any cause, including but not limited to negligence, violation of any law, carelessness, neglect, theft, or improper conduct, if police are called for any reason of/for any persons entering, occupying or visiting the leased premises. We are not responsible for personal items lost, stolen, or left behind, or left behind if removed from property. Occupant's or guests' personal property, including vehicles, are not insured by Owner, Owner's agent against loss or damage due to theft, fire, vandalism, rain, water, criminal or negligent acts of others or any other cause. Violation of these will result in immediate cancelation of stay/remainder of stay without refund.
GOOD NEIGHBOR POLICY - APPLY TO YOU AND THIS PROPERTY This home is located in a quiet residential neighborhood and the City and owner strictly enforces all applicable city ordinances that relate to occupancy, unnecessary or loud outdoor noise, and minimum age requirements.
GOOD NEIGHBOR POLICIES - CITY NOISE ORDINANCES - IMPORTANT
HOUSE RULES: You certify that each responsible party/guest is 21 years of age or older and agree to honor the specified occupancy limits for this home and conduct yourselves in a manner respectful of neighbors by refraining from loud or unnecessary outdoor noises, disruptive parties, over-occupancy or any activity that interferes with the quiet enjoyment of neighbors, traffic flow, the community, and residents. Renter/ tenants and guests will maintain the home in good order and appearance at all times and will not disturb, annoy, endanger or inconvenience neighbors or prompt written or verbal complaints to the owner from police, neighbors and bystanders.
ACCELERATED EVICTION - OUTDOOR NOISE - OVER-OCCUPANCY - VIOLATION OF LEASE: Excessive Amplified outdoor music of any kind is not allowed by City ordinance. Laws that are designed to maintain the relaxing and restful qualities that make the area a special place are strictly enforced. It is understood and agreed that ANY loud or large party, violations due to over-occupancy, unnecessary outdoor noise, indoor noise that causes neighbors to complain, or for violations of minimum age requirements of homes can result in immediate eviction and forfeiture of all funds plus up to $1500.00 charge and/or entire security deposit on Airbnb. In addition, renters may also be responsible for fines issued directly by city officials or police for good neighbor policy violations. The minimum fine for City citation will be issued directly by the City without further notice if a neighbor is disturbed, a complaint is outdoor music is played or if indoor music is audible from the property line. Lessee may not let, sublet or assign this lease for all or any part of the premises. Lessee may not plug electric vehicles or RV's into home without prior written consent of homeowner. Owner does not warranty or guarantee and is not liable for failures of, including, but not limited to any of the property's equipment, systems, appliances, as malfunctions or repair items cannot always be foreseen. ****Outdoor Surveillance cameras are located only at outside entry points for your safety and security of the home.****

PHOTOGRAPHY, EVENTS: Commercial photography and Events are NOT permitted without prior expressed written consent of owner.
NOTICE - SAFETY RULES - ASSUMPTION OF RISK - RELEASE OF LIABILITY & INDEMNIFICATION You are responsible for the safety of you and your guests. Renter/tenant acknowledges that the safety of yourself, your guests, depends on you. Coconut palms in the back and front yards have coconuts and occasionally debris that fall often and are very dangerous. As well as risk of animals, insects etc. Your attentive personal supervision is absolutely required to avoid risk of serious injury and/or death. By signing this contract, you are aware of and assume the risk for yourself, your party and for any guests or invitees during your lease. We are not responsible for accidents. You agree to indemnify and hold harmless from any and all liability (active or passive) the lessor and/or property owners, from any harm or injury caused by using the home inside and outdoors as well as equipment - or the Property leased by this contract. You and your guests and invitees agree that you use the home, yard and equipment completely at your own risk. By signing this lease and liability release, you agree to honor all important safety guidelines.
RELEASE OF LIABILITY - HOLD HARMLESS AGREEMENT Lessee(s) shall indemnify and hold harmless the Lessor / Property Owner, free and harmless from any and all liability, claims, loss, damages, demands or expenses, including counsel fees and costs, arising (a) by reason of the death or injury of any person, including Lessee or any person who is a guest or invitee of Lessee, or (b) by reason of damage to or destruction of any property, including property owned by Lessee or any person who is a guest or invitee of Lessee, caused or allegedly caused by (1) any cause whatsoever while that person or property is in or about the Property or in any way connected with the Property during Lessee's occupancy; or (2) any matter connected with Lessee's occupation and use of the Property. CLEANING: A non-refundable departure cleaning fee is required on all rentals. We ask that guests treat the home with care, leaving the property in the same general condition as found upon arrival. Within the 1st hour of arrival, if you are not satisfied with the cleaning, please contact host via Airbnb message thread so that we can attend to your specific requests. No cleaning fees are refunded. Each property is inspected after guest departure. Additional charges will apply for stains on carpets, furnishings, linens, or towels ( we have non white towels and paper towels for spills etc.), excessively dirty ovens, stove-tops, dirty dishes, excessive trash & moved furniture or appliances. These are not normal wear and are not covered as part of the cleaning fee. Items requiring extra cleaning at departure will be charged to guest security deposit.
CANCELLATIONS: Airbnb Firm policy. If you choose a nonrefundable option, please remember we abide by our cancellation policy.
NO SMOKING/FEE: Smoking of any kind (vaping included) is not allowed in or on property. Guest agrees to pay a $500 a day Smoke Damage Cleaning fee if any sign or smell of smoke is encountered by host or cleaning crew after guest checks out. The fee will cover costs to remove odors from the home, and lost revenue during cleaning.
INTERNET USE: Downloading copyrighted material using the home's internet service provider is illegal and may result in loss of internet access and fines.
NO REFUNDS NO CREDITS: We want your visit to be enjoyable, comfortable and pleasant. It is understood that in renting a private vacation home, there are many situations that are by nature beyond the control of the owners and credits or discounts will not be granted for such. Examples that are not guaranteed nor warranted and will not warrant any refund or credit of rental monies, include, but are not limited to: failure of systems, AC or heat, appliances, electronics, or cable tv not working, the home's systems or mechanical malfunctions, plumbing, Internet, construction taking place in the area, a home not decorated or accommodated to your tastes/expectations, bad weather, condition of landscaping, a neighborhood disturbance/noise. In the rare event of a mechanical malfunction or inconvenience, we will do our best to resolve quickly. Repairs, if any, will be accomplished as soon as possible, taking into consideration service personnel workload, parts availability, and nature of repair. However, it is understood that no refund or credits will be granted for any early departures or system malfunctions. Expenses for unnecessary service calls are the responsibility of the Guest.
RESERVATIONS: Cancellation policy goes into effect when payment or a confirmed reservation has been accepted to reserve the calendar for your stay.
HOME DIRECT CHECK-IN & KEYS: Check-in for guests is 4:00 p.m. In the event that extensive cleaning and/or repairs are required, check-in may be delayed until after 4:00 p.m. There will be no refund for delayed check-in due to extensive cleaning and/or repairs. Guest is not permitted on the property prior to check-in. The property has secure keyless entries. You will receive your code combo in a message prior to arrival. Important: The moisture, heat, and wind of our climate creates a tough environment for home mechanical systems. This can sometimes result in equipment failure. Every reasonable effort will be made to remedy unforeseen situations and correct any problems in as timely a manner as possible. No refunds or credits due to malfunctions in systems or equipment or other guest dissatisfaction. We reserve the right to inspect and service the home during your visit, including, but not limited to the required gardener service arranged by the homeowner.
CHECK-OUT is promptly at 10:00 a.m. on the day of departure unless specific arrangements are made in advance. Unauthorized late departures will be charged an additional night. Please close and lock all doors, sliders, windows, a fee will be charged for leaving the home unsecured. Please turn off lights, fans, and televisions. Before departing, please bag trash and place it in containers provided, or outdoors if too full. All dishes & cookware should be cleaned and put away or placed in dishwasher.Floors and furniture should be in same clean condition as you found them to prevent additional charges.
GOVERNING LAW, VENUE & TIME OF ESSENCE. This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Time is of the essence. Any legal action arising out of or relating to this Agreement shall be filed in a court of competent jurisdiction in county of property. WAIVER OF JURY. The parties agree to waive any and all right to a jury in any legal action between them arising out of or relating to this rental agreement.
ATTORNEYS FEES AND COSTS The prevailing party in any action between the parties, including arbitration proceedings, arising out of or relating to this Agreement shall be entitled to recover his reasonable attorney’s fees and costs, up to an amount not to exceed $2500.
ENTIRE AGREEMENT. This agreement constitutes the complete agreement between Lessor and Lessee and sets forth the obligations of the parties to each other. Any oral agreements or representations respecting the Property not expressly set forth in this instrument are null and void. All prior negotiations between the parties are included in this agreement. This agreement may not be amended, modified, or changed, except in a writing signed by Lessor and Lessee. Thank you, we appreciate your business and look forward to hosting you!
